entitled to avail himself of the provisions of this
section, whether he be sole or part owner of any
land in this state ; provided, that in the case of
the death of any citizen who may have located
and appropriated any lot under the provisions
of this section, his executors or administrators
shall have the exclusive use, possession and
control of such lot as fully as the person so
dying had for the purpose of protecting, culti-
vating and removing the oysters planted on
said lot for the period of three years from the
date of the death of the person appropriating
such lot ; and any person committing a'trespass
upon said lot, or taking oysters bedded thereon,
without the consent of such executor or admin-
istrator, shall be liable to the penalties imposed
by this act for taking bedded oysters.

Effective.

SEC. 2. And be it enacted, That this act shall
take effect from the date of its passage.

Chapter 506.
AN ACT to regulate the proceedings in distress
for rent in St. Mary's county, and allow the
tenant whose goods are distrained to super-
sede the claim for rent before any justice of
the peace.
SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That after the passage of this

act in all cases where property has been dis-
trained for rent in St. Mary's county, and is in
the hands of any bailiff or agent of the landlord,
and the tenant shall go before a justice of the
peace for said county and confess judgment in
favor of the landlord for the amount of rent
claimed and the costs of the distraint, and shall
also have made before the said justice a superse-
deas, which shall be substantially in the follow-
form : "State of Maryland.........of.........to wit :
We do confess judgment to.......... for the sum of
