its property and franchises to the company cre-
ated by this act.
SEC. 10. And be it further enacted, That the

corporation mentioned in the preceding sections
of this act shall not construct any new railway
under the provisions of this act, without having
first obtained the assent of the mayor and city
council of Baltimore to the same, and' all the
provisions of the act of eighteen hundred and
eighty-two, chapter two hundred and. twenty-
nine, entitled "An act to secure the benefit of a
five cent fare upon the passenger horse rail-
ways in the city of Baltimore," which require
the payment of a tax on the gross receipts of
horse railway companies in the city of Balti-
more, shall be applicable to the corporation
created by the provisions of this act and to all
its railways, whether impelled by horses or
otherwise; nor shall the corporation created by
the provisions of this act require or hold any
of the franchises or railways of the Baltimore
city passenger railway company, nor to operate
said railways or any of them, nor construct any
of the railways, which it is authorized by this
act to construct upon the streets now occupied
by the railways of said Baltimore city passen-
ger railway company, nor use any of the rail-
ways of the latter company without its assent.
