SEC. 6. And be it enacted, That any person
shall be regarded as practicing medicine within

the meaning of this act who shall profess pub-
licly to be a physician and prescribe for the
sick, or who shall append to his name the letters
M. D. ; but nothing in this act shall be construed
to prohibit students from prescribing under the
supervision of preceptors, or to prohibit gratui-
tous services in cases of emergency; and this act
shall not apply to commissioned surgeons in the
United States army, navy or marine hospital
service, nor shall it apply to physicians or sur-
geons not resident .in this state, who may be
called in consultation within this state.
SEC. 7. And be it enacted, That the state

board of health may refuse certificates to per-
sons presenting diplomas from colleges or
schools not in good standing, or to individuals
guilty of professional or dishonorable con-
duct or of nominal practice, and they may re-
voke certificates for like causes ; no such cer-
tificate shall be refused to any such person
because he or she may belong to a different
recognized school of medicine from any member
of said board.
SEC. 8. And be it enacted, That any person

plying with the provisions of this act, or who
shall advertise himself to the public as skilled in
the treatment of any particular disease or injury
without first having secured and recorded the
certificate of the state board of health, or who
shall, by writing, printing, or any other method,
publicly profess to cure or treat diseases, injury
or deformity by any drug, nostrum, manipula-
tion or other expedient, without having com-
plied with the provisions of this act, or who
shall represent himself as being authorized to
practice medicine or surgery in this state, when
in fact he is not so authorized, shall be deemed
guilty of a misdemeanor, and upon conviction
thereof shall be fined not less than one hun-
dred dollars nor more than five hundred dol-
lars, or be imprisoned in jail not less than three
months nor more than twelve months, or be
both fined and imprisoned at the discretion of
the court.
