such officers as they may deem necessary to
carry into effect their ordinances ; and at the
time of electing said commissioners, and in the

manner hereinbefore provided for their election,
there shall be elected a town bailiff, who shall
be removable by said commissioners for neglect
of duty or malfeasance in office, who shall be
ex-officio collector of the town taxes, and shall
within said town have all the authority of a
constable ; and of the persons voted for at said
election for town bailiff the one receiving the
highest number of votes shall be the bailiff of
said town for the ensuing year, and until his
successor is duly elected and qualified ; and if
at said election there shall be a tie between any
two or more persons receiving the highest
number of votes, so that there shall be no elec-
tion of town bailiff, the said commissioners may
order a new election of town bailiff at such time
and after such notice as they may deem proper ;
and if a vacancy should occur in the said office
of town bailiff, the said commissioners shall fill
said vacancy by the appointment of some person
to act as town bailiff for the remainder of the
unexpired term.
SEC. 47. The said bailiff shall give bond, to be
approved by the county commissioners as other

constables, for the faithful performance of his
duty as constable, and also bond to said presi-
dent and commissioners for the faithful per-
formance of his duty as town bailiff and collec-
tor of town taxes, and the faithful performance
of such duties as shall be imposed on him by the
ordinances of said president and commissioners.
SEC. 48. That said bailiff may enforce the pay-

ment of town taxes in the same manner and with
like effect as collectors of state and county taxes
may enforce the payment of state and county
taxes, and said bailiff shall, before he enters
upon the duties of his office as such bailiff or
collector, take an oath before some justice of
the peace for said county that he will faithfully
and impartially perform the duties of his said,

SEC. 2. And be it enacted, That this act shall
take effect from the date of its passage.
