LAWS OF MARYLAND.

Chapter 309.

AN ACT for the better protection of fish in the
rivers and streams running through or border-
ing upon Howard county, and to provide for
the placing of fish ladders at all dams on such
rivers and streams.

SECTION 1. Be it enacted by the General Assem-

sage of this act, it shall not be lawful for any
person or persons to take, capture, or destroy any
fish by fish pots, fish basket, eel weirs, brush or
fascine nets, set net or set nets, dip net or dip nets,
dynamite or explosives of like nature, or lime ; or
to destroy them by shooting them or striking
through the ice in any of the rivers or streams
which run through from or border upon Howard
county ; provided that nothing in this act shall
apply to the catching of herring, hickory shad
or gudgeons in said waters.
SEC. 2. And be it enacted, That the owner or

owners of any dam now located or which may
hereafter be erected on any of the rivers or
streams aforementioned, above tide-water, shall
and are hereby required to make, or cause to be
made and kept in repair proper fish ladders, and
have them placed upon all such dams, so as to

course up and down the same.
SEC. 3. And be it enacted, That if the owner or

to comply with the provisions of the preceding
section within sixty days from the passage and
approval of this act, he, they or either of them
shall be liable, upon conviction thereof by sum-
mary process before any justice of the peace of
this state, in the county nearest to or adjacent
to where the dam or dams may be situated, to a
penalty of not more than one hundred dollars
nor lees than twenty dollars, or to imprisonment
in the county jail for not more than sixty days
nor less than thirty days, said liability recurring
on failure of said party or parties to erect such
fish-ways after sixty days from the date of every
such trial; net fines in all such cases to be turned
