fines and penalties imposed by said ordinances
shall be collected by suit before a justice of the
peace in the name of the said corporation as
other small debts are collected; and in case of
default of payment of said fines and penalties,

and costs attending collection of same, the of-
fender may be imprisoned in the county jail for
a term not exceeding sixty days, in the same
manner that commitments are made for fines
imposed by the circuit court of the judicial dis-
trict in which said town is situated, on convic-
tion for misdemeanor; but the said mayor, or a
majority of said council, shall have power to re-
mit or release said fines, penalties, forfeitures
and costs, or any part thereof, at their discre-
tion; but any party fined, or subject to a fine or
forfeiture, may, within five days after the same
shall be imposed and judgment recovered, super-
sede or stay the same for thirty days by giving
ample security to the justice of the peace; and

said party shall have a right to appeal within
five days thereafter to the circuit court for Car-
roll county upon giving ample security for the
payment of whatever fine and costs may be ad-
judged against him in said circuit court.
SEC. 11. Be it enacted, That the said mayor

and council shall have full power to make all
such regulations and ordinances not inconsist-
ent with the laws and constitution of this state
as from time to time they may deem wise,
equitable and expedient for the comfort, health,
convenience and prosperity of said town a.nd its
inhabitants; for the prevention and removal of
nuisances and the preservation of health and
suppression of vice and immorality within the
limits of said town ; to provide by ordinance for
the immediate arrest, without warrant, of any
person violating any town ordinance by riotous
or disorderly conduct, or driving or riding
through the streets, where, in the judgment of
the mayor or constable of the town, the delay
necessary to procure a warrant would be danger-
ous to the peace and quiet of the town, or the
lives, limbs or property of the citizens.

SEC. 12. And be it enacted, That the said
mayor and council shall have full power and
authority annually to appoint a constable whose
