SEC. 3. And be it enacted, That any person or
persons who may violate any of the provisions
of this act shall, upon conviction thereof before
any justice of the peace of said county, be fined
for each and every offence the sum of fifty dol-
lars and costs of prosecution, and be committed
to the county jail until said costs and fines are
paid ; and of all fines collected under this act
one-half shall go to the informer and the other
half be paid to the county commissioners for the
betterment of public roads in said county.
SEC. 4. And be it enacted, That the right of

appeal from the decision of the justice of the
peace in all cases is reserved to the defendant to
the circuit court ; and provided that unless the
defendant shall give good and sufficient bond or
security for his appearance at the next term of
court, and to pay all fines and costs that may be
imposed upon him, he shall stand committed to
the county jail until said fines and costs are
paid, or until the said circuit court, upon appeal,
shall reverse the judgment of sentence of the
said justice of the peace.

SEC. 5. And be it enacted, That this act shall
take effect from the date of its passage.

AN ACT to repeal and re-enact section one of
the acts of eighteen hundred and eighty-four,
chapter two hundred and seventy-eight, enti-
tled "An act to repeal and re-enact chapter
one hundred and thirty-four of the acts of
eighteen hundred and seventy-six, relating to
the setting of pound nets in the waters of Elk,
Sassafras and Bohemia rivers, and their tribu-
taries, in Cecil county.
