commissioners, and may be put in suit by the
said commissioners, or any one suffering from
the neglect of said supervisor in keeping his
road in proper order, or any other failure of
duty ; and the said supervisors shall also be
liable to indictment in the circuit court for Som-
erset county, and, on conviction for any viola-
tion of his duties, under this act, shall be fined
not exceeding two hundred dollars, and stand
committed until said fine and costs are paid. All
fines under this section to be paid to the county
commissioners, and applied by them to the use
of public roads in Somerset county.
SEC. 11. And be it enacted, That the county
commissioners of Somerset county shall each

shall constitute and be called " The Public Road
Fund," and shall be used exclusively for the
improvement and betterment of the public roads

road machine of the best and most useful kind
for the use of the county, and employ the same
under the direction of the road supervisors in
their respective districts, and if it shall be found,
after actual trial, that such machine or other

cal, they are authorized and directed, in their,
discretion, out of said fund, to purchase such a
number and distribute them among the several
road districts in the county as they may deem
most conducive to the public interest.
SEC. 12. And be it enacted, That, in addition
to the general fund provided for by the pre-
