nothing herein contained shall authorize said company to take
private property for its use without just compensation there-
for as agreed upon between the parties or found by a jury as
aforesaid, being first paid or tendered to the party or parties
entitled to such compensation.

SEC. 8. And be it further enacted, That the said bridge,
when built and completed, and the land connected with the
same and its appurtenances and all the profits, tolls and fran-
chises pertaining to the same, shall be vested in the said New
Warsaw Bridge Company, and it shall be lawful for the
directors of said company at all times hereafter to demand and
receive such reasonable tolls for the passage and use, of said
bridge by any person or persons as the said directors may from
time to time fix and agree upon, and they may do all things
requisite or necessary to regulate the use of said bridge and
the immediate ways thereto by the public.

SEC. 9. And lie it further enacted, That the said directors
may make and declare a dividend or dividends of the net
profits of said bridge from time to time as they may see fit.

SEC. 10. And be it further enacted, That if any person or
persons shall wilfully injure any part or parcel of said bridge,
or obstruct the free passage over the same, or the ways leading
thereto, or shall attempt to pass over said bridge without pay-
ing the toll for such passage authorized as aforesaid, he, she or

they shall forfeit and pay to the State of Maryland for every
such offence a sum not exceeding fifty dollars, to be recovered
before any justice of the peace of the said State in and for
Baltimore county, one-half of which tine shall be paid to the
informer; and it such fines and costs are not paid forthwith,
the person so convicted shall be committed to the jail of Balti-
more county for not less than thirty days; but the right of
appeal from any such judgment of such justices of the peace
to the Circuit Court for Baltimore county is hereby reserved to
the said person. But nothing herein contained shall be taken
or construed to interfere with the right of said New Warsaw
Bridge Company to receive from such person so offending
damages at law for any damage the said company may have
sustained by his said acts.

Penalty.


SEC. 11. And be it enacted, That this act shall take effect
from the date of its passage.

Approved April 6th. 1894.
