of agitating and disturbing the waters of Magothy river, in
Anne Arundel county, on the creeks, coves or tributaries
thereof with a view to driving fish in any seine, net, pound
net, fyke, fish-pot, basket or any other device or implement for
catching fish. Any person violating the provisions of this
section shall be deemed guilty of a misdemeanor, and on con-
viction thereof before a justice of the peace of said county,

shall be fined not less than ten dollars nor more than fifty
dollars and the costs of prosecution for each offence; one-half
of said fine to go to the informer and the remainder to be paid
to the County Commissioners for the use of the public roads in
said county; in default of payment of the said fine and costs
the offender shall be committed to the county jail for thirty
days or until such tine and costs are paid, whichever shall first
occur.

Penalty.

SEC. 2. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 397.

AN ACT to repeal Sections one, two, three, four, five, six,
seven, eight, nine, ten and eleven of Article sixty-one of
Public General Laws, entitled "Manures and Fertilizers,"
as amended and re-enacted by Chapter three hundred and
eighty-seven of Acts of 1890, and to re-enact the same
with amendments.

Effective.

SECTION 1. And be it enacted by the General Assembly of
Maryland, That sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 of

article 6i of the Code of Public General Laws, as amended

and re-enacted by chapter three hundred and eighty-seven of
acts of 1890, he and the same hereby are repealed and re-
enacted to read as follows :

Repeal.

SEC. 1. That the term fertilizer, as used in this act, shall be
held to mean any commercial fertilizer, or any article, sub-
stance or mixture sold, offered or exposed for sale for manurial
purposes within this State, of which the selling price shall be

more than ten dollars per ton of two thousand pounds. That

the term brand, as used in this act, shall be held to mean the
