CHAPTER 40.
AN ACT to repeal Sections 55 to 89, both inclusive, of Article
56 of the Code of Public General Laws, title " Licenses,"
sub-title "Spirituous and Fermented Liquors by Retailers,
&c.," so far as the same apply to St. Mary's County, and to
repeal Chapter 427 of the Acts of eighteen hundred and
ninety -two, entitled, an Act to regulate the sale of spirit-
uous and fermented liquors in St. Mary's County, and to
regulate the issuing of license therefor; and to add ceitain
new sections to Article 19 of the Code of Public Local Laws,
title "St. Mary's County," sub title "Spirituous and Fer-
mented Liquors," said sections to follow immediately after
Section 79, and to be numbered Section 79 A and 79s.
SECTION 1. Be it enacted by the General Assembly of

Repeal.

Maryland, That sections 55 to 89, both inclusive, of article
56 of the Code of Public General Laws, title "Licenses," sub-
title "Spirituous and Fermented Liquors by Retailers, &c.,"
as far as said sections apply to St. Mary's county, be and the
same are hereby repealed.
SEC. 2. And be it enacted, That chapter 427 of the acts of

New sections.
|
eighteen hundred and ninety-two, entitled an act to regulate
the sale of spirituous and fermented liquors in St. Mary's
county, and to regulate the issuing of license therefor, be and
the same is hereby repealed, and that certain new sections be
and the same are hereby added to article 19 of the Code of
Public Local Laws, title "St. Mary's County," under the new
sub-title "Spirituous and Fermented Liquors," to follow sec-
tion 79, to be known as sections 79 A and 79 B, and to read as
follows :
79 A. Upon application of any citizen of St. Mary's county,

and the payment of the license fee hereinafter provided, the
clerk of the Circuit Court for St. Mary's county shall issue to
the applicant a license to sell spirituous or fermented liquors
and lager beer in any quantities from one drink up to four
gallons; provided, that no person selling such liquors under a
decree or provision of law, or the execution of a judgment of
a court of competent jurisdiction, nor sales in unbroken pack-
ages by the maker thereof, or cider or native wines, shall be
required to take out a license; and all licenses issued hereunder
