87 A. In the absence of fraud, negligence or willful trespass,
the measure of damages for the wrongful working and abstract-
ing of another's minerals, is the value of the minerals in their
native state before severance, to the person from whose prop-
erty they were taken, at the time of the taking; but if one
furtively, or in bad faith, works and abstracts minerals from the
land of another, the party so offending may be charged with
the whole value of the minerals taken, and allowed no deduc-
tion in respect of his labor and expenses in getting them.

SEC. 9. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 288.
AN ACT to appropriate a sum of money to pay the A. S.
Abell Co., and others, for publishing the Constitutional
Amendment and Governor's Proclamation, according to
agreements made with the Governor of the State of Mary-
land.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Comptroller of the State be and he is
hereby authorized and directed to issue his warrant upon the
treasurer of the State, for two hundred and twenty-seven and
25-100 dollars in favor of the A. S. Abell Co., of the Baltimore
Sun; for one hundred and forty -seven and 90-100 dollars in
favor of Charles C. Fulton & Co., of the Baltimore American ;
for one hundred and fifty dollars in favor of E. Raine, of the
German Correspondent; for one hundred and fifty dollars in
favor of the Evening News Publishing Co.; for one hundred
and seventy-two and 33-100 dollars in favor of A. Bechhofer,
manager of the Morning Herald; for one hundred and thirty-
five dollars in favor of John W. Aivrett, (to the use of the
Second National Bank of Cumberland,) of the Cumberland
Evening Times; for one hundred and ten dollars in favor of
John W. Aivrett, to the use of the Second National Bank of
Cumberland, of the Cumberland Alleganian; for one hundred
and ten dollars in favor of Moss and Wathen, of the Annapolis
Republican; for one hundred and ten dollars in favor of W.
M. Abbott, of the Annapolis Capital; for one hundred and
ten dollars in favor of P. E. Porter, of the Annapolis Gazette;
