SEC. 26. The first brigade already formed and organized
out of the volunteer uniformed organizations now existing,
together with such others as may be provided for by law, shall
constitute a body of active militia, shall consist of not more
than forty companies, infantry, cavalry and artillery, to contain
not more that twenty-five hundred men, and shall be known
as "The Maryland National Guard."

SEC. 27. That "The Maryland National Guard," until other-
wise provided by law, shall consist of the following organi-
zations : The First Regiment, the Fourth Regiment, the Fifth
Regiment, the Second Battalion and the three independent
colored companies now organized; that the said three regi-
ments may be maintained or increased to twelve companies
each, either by the assignment of companies already existing
or by enlisting new companies, when in the judgment of the
commander-in-chief it may be necessary or desirable, provided
the whole brigade shall not consist of more than forty (40)
companies as aforesaid, and provided further that the com-
mander-in-chief may, when he deems it advisable, change the
formation of regiments and battalions so as to promote their
efficiency; that the commander in-chief may, when two or
more companies in the same town shall be reduced below forty
effectual enlisted men, or when in his judgment it may
be best for the good of the service, consolidate them into
one company, and order a new organization thereof, pro-
vided that nothing in this section shall be construed to
limit or impair the authority of the Commander-in-chief,
in his discretion, to muster out of service any inefficient
company, as provided in section 41 (forty -one) of this
article; that in addition to the infantry command of the State,
the commander-in-chief may, whenever, in his judgment, the
State appropriation shall justify the expenditure, and the
efficiency of the service require it, authorize and direct the
enlistment and formation of a company or troop of cavalry,
and the enlistment and formation of a battery of artillery of
two sections and four guns, the sections to be enlisted in the
same town and county, or one section in one county and one
in another, as the commander-in chief may direct, each sec
tion to be commanded by such officers as the commander-in-
chief may direct and commission, and the whole battery to be
under the command of a captain, to be elected by the officers
of the two sections; the kind and calibre of the guns shall be
designated by the commander-in-chief, and he may, in his
discretion, assign one or more of said guns or sections to such
