required for said widening, or in case they or any of them be a
feme covert, (under age), non compos mentis or absent, the
said company is authorized and empowered to acquire by con-
demnation any land or any interest therein required for the
purpose of widening the road as aforesaid, and shall, in exer-
cise of such powers of condemnation, proceed as provided in
sections 2iS to 254, inclusive, of article 23 of Public Gen-
eral Laws, title " Condemnation of Property by Corporations."

Effective.

SEC. 2. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 117.

AN ACT to authorize and empower the Rockville and
Bethesda Turnpike Company, of Montgomery County,
Maryland, to condemn the turnpike road of the President,
Managers and Company of the Washington Turnpike
Company.

Preamble.

WHEREAS, The Rockville and Bethesda Turnpike Company,
of Montgomery county, Maryland, has been duly incorporated
under the provisions of article twenty-three of the Code of
Public General Laws of this State, for the purpose of con-
structing a turnpike road in said Montgomery county, not
exceeding twelve miles in length, from Rockville to Bethesda,
in said county, over and upon the line or route of the turn-
pike road of the President, Managers and Company of the
Washington Turnpike Company, a corporation duly incorpo-
rated by act of the General Assembly of Maryland, passed at
the November session, eighteen hundred and tive, chapter
seventy nine; and whereas, the said President, Managers and
Company of the Washington Turnpike Company has aban-
doned the said turnpike road and removed its gates therefrom
and ceased to charge tolls thereon; and whereas, doubts have
been expressed as to the power of the said The Rockville and
Bethesda Turnpike Company of Montgomery county, Mary-
land, to condemn the said turnpike road of the said President,
Managers and Company of the Washington Turnpike Com-
pany without express legislative authority so to do; now,
