perform the duties imposed by this section, he shall be subject
to indictment in the Circuit Court for Washington county, and
to a fine of twenty-five dollars, to be recovered upon conviction
thereof. The said judges shall be conservators of the peace
during the continuance of the election and until the ballots
shall be counted, and the necessary certificates required by
law shall be made out by the judges and clerks, and shall be
vested with power and authority to commit offenders for any
breach of the peace, in like manner now vested in justices of
the peace, and shall have authority to administer oaths or
affirmations to any person touching his qualification as a voter.

than one clerk, one of whom shall he of a different political
party from the other, and before acting he or they shall take

well and faithfully keep a true record of all the voters whose
ballots are received for burgess, assistant burgess of Sharps-
burg (or for commissioners of Sharpsburg) at the election to be
held on the ——— day of September, A. D. —— , according to
the best of our ability." A box shall be kept in which all the
ballots received shall be deposited by the judges and the names
of all the voters shall be written down on lists by the clerks.
The polls shall be kept open from nine o'clock A. M. till four
o'clock P. M.

SEC. 10. At the close of the polls the judges of election

return, under their hands and seals, to the clerk of the Circuit
Court for Washington county, the number of votes cast for
each candidate, and return the persons receiving the highest
number of votes as duly elected, and they shall return at the

records of said election; and the said clerk shall file the same
and immediately notify the person or persons choser? of their
election, in accordance with the returns of the judges. The
burgess and commissioners shall convene at least once a month
during the year, and as much oftener as may be required.
