necessary to prescribe the duties and powers of said assessors;
provided, .however, that the assessment for town purposes
shall not exceed the assesments for State and county pur-
poses; and said commissioners shall have power, from time
to time, to pass such ordinances as they may deem proper
for the assessment, re-assessment, transferred and appeals
from assessments of the property in said town.

SEC. 10. And be it enacted, That all fines and forfeitures
imposed by the ordinances of the town shall be imposed by

the said president or any justice of the peace resident in
said town upon a warrant to be issued directed to the said
bailiff or any policeman of said town; and the person con-
victed, in default of the payment of the fine and costs, may
be committed to the Alleghany county jail or the lockup of
said town, and the said president or justice of the peace and
bailiff or policeman shall be entitled to the same costs as
are provided in similar offenses against the State.

SEC. 11. And be it enacted, That in case of the death or
