CHAP. 416

Assembly of Maryland, passed in the year 1898, and as
Section 93 of said Article was repealed and re-enacted
with amendments by Chapter 92 of the Acts of the Gen-
eral Assembly of Maryland, passed in the year 1902, by
repealing Sections 90, 91 and 93 of said Article 4, sub-
title "Department of Public Parks and Squares," and
re-enacting the same with amendments.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 90, 91 and 93 of Article 4 of the Code
of Public Local Laws of Maryland, title " City of Balti-

more," as the same was enacted by Chapter 123 of the
Acts of the General Assembly of Maryland, passed in the
year 1898, and as Section 93 was repealed and re-enacted
with amendments by Chapter 92 of the Acts of the General
Assembly of Maryland, passed in the year 1902, sub-title
"Department of Public Parks and Squares," be and the
same are hereby repealed and re-enacted with amendments,
so as to read as follows :

90. There shall be a department of public parks and
squares of the Mayor and City Council of Baltimore; the

commissioners, composed of five members, to serve without
pay, appointed by the Mayor in the manner prescribed in
Section 25 of this Article, one of whom shall be the presi-
dent thereof, and shall be so designated by the Mayor.
Their term of office shall be five years, one of them to retire
at the end of every year, at which time his successor shall be
appointed. The present board shall determine by lots their
terms of office, so as to provide for the retirement of one of
its members on the first Monday in October in the year
1906 and one at the end of each year thereafter succeeding ;
provided, however, that none of the present board shall
serve for a longer term than five years, unless re-appointed ;

of one thousand five hundred dollars ($1,500) per annum,
payable monthly, and he shall be the clerk of said board,
and shall perform such duties as may be prescribed by said
board. The said board shall perform such other duties as
may be prescribed by ordinances not inconsistent with this
