CHAP. 389

Repeal and
re-enact.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 9 of Article 12 of the Code of Public
Local Laws, title "Garrett County," sub-title "Birds and
Game," be and the same is hereby repealed and re-enacted
with amendments, so as to read as follows :

Game law.

Section 9. It shall not be lawful for any person to kill or
trap, destroy any wild turkey, pheasant or quail in Garrett
county until the first day of October in the ye'ar nineteen
hundred and eight, and after said date wild turkeys, pheas-
ants or quail may be killed or taken during the season now
allowed by law, but woodcock may be killed in said county
during the entire months of October and November in each
year; any landowner or tenant of a landowner in Garrett
county whose lands are being trespassed, or is hereby author-
ized to exercise all the powers of a game warden or deputy
game warden under the public general laws of this State
may arrest persons violating the provisions of this sub-title
of this article or of any other sub-title of this article referring
to birds, game or deer, and take the offender before a jus-
tice of the peace to be dealt with according to law, and
the possession of such birds or game shall be deemed prima
fade evidence of a violation of the laws on this behalf
enacted, and all guns and gunning apparatus, in case of con-
viction, shall be confiscated to the use of the owner or
lessee of the land on which the trespass occurs.
SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage, and that all Acts or parts of
Acts inconsistent herewith, so far as thus inconsistent, are
hereby repealed.

CHAPTER 390.
AN ACT to revive and extend the Charter of the Oheb
Sholom Congregation of Baltimore City.

Repeal.

WHEREAS, The Oheb Sholom Congregation of Baltimore
city was incorporated on the 25th day of November, in the
year 1854, by virtue of the general provisions of the Act of
Assembly made and passed at the January Session, 1852, said
Act being an Act relating to incorporating societies for use-
ful and beneficial purposes; and
