shall without delay proceed to elect a successor who shall
possess the same qualifications as herein provided for the

be absent for a shorter time, or vacate the office for a shorter
period, then and in such case the clerk shall act as Mayor
in the time thus vacated, and no election shall be necessary.
By and with the consent of the Council, the Mayor shall
appoint and employ all agents, servants and employes not
otherwise provided for by law, who may be required for the
purpose of said corporation, annually, and shall, by and with
the consent of the Council, fix the compensation for said
officers. He shall have the power to remove any officers so
appointed by him for cause; he shall have general super-
vision of the town; to preside at all sessions of the Council
and have a casting vote, see that the ordinances are enforced
and from time to time report to the Council such matters as
in his judgment require their attention; he shall have power
to administer oaths and to certify the same in all matters
pertaining to said corporation, and for the purpose of hear-
ing and determining all cases to which the corporation may
be a party he is hereby clothed with all the powers of a
justice of the peace except as to civil cases; he may pass
sentence and impose fines for all violations of the ordinances
of said corporation, or may imprison, or may both fine and
imprison offenders against said ordinances; and to carry
out his said powers he is hereby vested with the authority
to issue subpoenas for witnesses and compel their attendance
by fine for contempt, and shall have the power to include in
his fines for the violation of ordinances the usual costs which
are allowed to the justices of the peace and to witnesses and
to the bailiff for serving the process, such as are allowed
constables under the laws of this State; provided, that no
ordinance shall be passed imposing a fine of not less than
one dollar nor more than twenty-five dollars, nor for a term
of imprisonment exceeding thirty days; and provided, also,
that all fines imposed and collected shall be paid into the
treasury of the town. No order or resolution for the pay-
ment of money out of the town treasury shall be valid with-
out his approval in writing. During his term he shall hold
no other corporation office nor shall he be interested in any
contract in which the corporation is a party; he shall receive
the sum of twenty-five dollars per year for his official ser-
