authorized to purchase, agree and contract with the owner or
owners of any land which they may deem expedient or
proper to purchase and hold for the purpose of establishing
a public park or parks or adding to or improving any land
now held for park purposes in the city of Frostburg or
adjacent thereto in Allegany county, Maryland.

POWER OF CONDEMNATION FOR PARK PURPOSES.

164. That if the said Mayor and Councilmen of Frostburg
cannot agree, or if there be any incapacity or inability to

contract with the owner or owners of said land or real estate
which they may deem necessary or proper for the establish-
ing of a public park in or near the city of Frostburg in
Allegany county, or if such owner or owners shall be absent,
out of the State or unknown, or without legal capacity to
contract by reason of infancy, coverture or otherwise, it shall
be lawful for the Mayor and Councilmen of Frostburg to
secure by condemnation any lands or real estate which they
may deem necessary or proper for the purpose aforesaid, in
the same manner and by the same proceedings as is now
provided for condemnation by corporations under Article 23,
Sections 248 to 252, inclusive, of the Code of Public General
Laws of the State of Maryland.

165. The Mayor and Councilmen shall have the power to
provide for the laying out, opening, extending, widening,

straightening, or re-locating of any street or alley, or parts
thereof within the city, which in their opinion the public
welfare or convenience may require; to provide for ascertain-
ing whether any and what amount in damage of value will be
caused thereby, for which the owner or possessor of any
property, through which said street or alley may pass, ought
to be compensated by the appointment of commissioners to
assess the same; to provide for assessing or levying, either
generally on the whole or assessable property of the city,
or specially on the property of the persons benefited, the
whole or any part of the damages or expenses which will be
incurred in laying out, opening and extending, widening,
straightening or re-locating such street or alley, or parts
thereof, and grading the same; to provide for collecting and
paying the compensation awarded any person before any
such street or alley or part thereof shall be laid out, opened,
