CHAP. 262

spring, brook, water or water course as aforesaid, earth,
timber, stone or other material which they may deem
expedient or necessary to purchase or hold, in Allegany and
Garrett counties, for the purpose of introducing an additional
supply of water into or improving the present supply of
water in the city of Frostburg.

161. That if the said Mayor and Councilmen cannot agree,
or if there be any incapacitv or disability to contract with

the said owner or owners of said real estate, spring, brook,
water or water course as aforesaid, earth, timber, stone or
other material, or with the owner or owners of such land
through which they may find it necessary to have a right of
way or entry or passage, for the purpose of carrying the
said water into or through the said city; or if such owner
or owners shall be absent, out of the State or unknown, or
without legal capacity to contract, by reason of infancy,
coverture or otherwise, it shall be lawful for the Mayor and
Councilmen of Frostburg to secure by condemnation any
such lands, real estate, spring, brook, water or water course,
easement or franchise, earth, timber, stone or other materials
which they may deem necessary, in the same manner and by
the same proceedings as now provided for in condemnations
by corporations, under Article 23, Sections 248, 249, 250,
251, 252 of the Code of Public General Laws of Maryland.

162. And the said Mayor and Councilmen shall have and
are hereby invested with full power and authority to enact

and pass all ordinances, which from time to time they may
deem necessary and proper to effect the objects herein
specified, and to regulate the introduction and use of said
water and improvements thereof, and for the protection and
preservation of its works, machinery and property connected
therein, and it shall be the duty of said Mayor and Council-
men that the ordinances so passed are carried out and
enforced.

PURCHASE OF LAND FOR PARK PURPOSES.

163. And the said Mayor and Councilmen of Frostburg
are hereby authorized to receive, have, hold, use and enjoy
