this and other provisions of this Act, as well as the ordi-
nances enacted by the said town commissioners, as pro-
vided in this Act; and any wilful neglect upon his part to
enforce either of them upon coming to his notice shall be
malfeasance in office.
SEC. 2. And be it enacted, That all Acts or parts of Acts

repealed, and that this Act shall take effect from and after

CHAPTER 581.

AN ACT for the relief of J. Edward Kirby and Kate Kirby,
being an Act directing Louis Janowitz, administrator of
J. Edward Kirby, Jr., deceased, to pay over to them the
estate of said deceased now in his hands, and amounting
to two hundred and twenty-seven dollars and nineteen
cents ($227.19).

WHEREAS, J. Edward Kirby and Kate Kirby, his wife, of
Baltimore city, about 1859 adopted a waif then six months

J. Edward Kirby, Jr., and raised and educated him, and he
always thought he was the legitimate off-spring of his foster
parents, and treated them as if they were his parents; and
WHEREAS, In March, 1903, the said J. Edward Kirby, Jr.
died intestate, unmarried and without issue; and
WHEREAS, Had he known the fact that his small accumu-
lations would go to the public school fund of Maryland in
case of his death intestate and without issue, it is believed
he would have willed his estate to his foster parents, who
are now old and poor; and
WHEREAS, The State treasury officials have recommended
the payment of the money hereinafter mentioned; therefore,
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Louis Janowitz, administrator of the estate of

J. Edward Kirby, Jr., be and he is hereby authorized and
directed to pay over to J. Edward Kirby and Kate Kirby
the estate in his hands of the said J. Edward Kirby, Jr.,
