stituted and declared to be a body politic and corporate, under
the name and style of the Montgomery Electric Light and
Railway Company of Montgomery county, and under such
name and style shall have perpetual succession, and may sue
and be sued, defend and be defended at law or in equity; to
have and use a common seal or corporate seal, and to alter or
remove the same at pleasure and otherwise in all things
to do, execute and perform whatever any corporation
and body politic or individual may or might lawfully do,
execute and perform within the scope and for the object
and purposes of said corporation, as follows, namely: To
construct and lay down and operate a railroad with the
necessary and proper switches, turnouts, and any and all
mechanical contrivances and devices and appliances suitable to
operate an electric railway, and to run thereon cars and car-
riages for the carrying of passengers and freight, drawn or pro-
pelled by electricity or any other motive power, beginning at
the railway station of the Capital Traction Company at Cherry
Chase Lake, in Montgomery county, Maryland; thence to the
town of Kensington, and thence to Wheaton Postoffice, and
thence to the town of Olney, in said Montgomery county, and
thence to Sandy Springs, in said county, with such laterals or
branches within said county of Montgomery as said corpora-
tion may deem advantageous to acquire, hold or manage; and
said corporation is hereby authorized to change said route or
any portion thereof between its two terminals if it should find
the same to be practicable or necessary; to hold, manage or dis-
pose of any personal or real property essential or relevant to
the uses aforesaid, and also to acquire title to such adjacent

line or lines of railway, or any lateral or branch thereof, and
to develop, improve, hold and sell; and they shall also have
power to manufacture and sell and furnish such quantities of
electric light, gas of any kind and electric power as may be
required or desired at any point in said county, and to contract
for and furnish electric light or gas light or illuminant of any
kind for lighting the streets, wards, public or private build-
ings in said county, and any city or town therein, and for
motive power and other purposes; and said corporation is
hereby authorized and empowered to lay, purchase and con-
struct or build lines and conductors and erect poles, lay
conduits under,., along or upon or over the streets, squares,
lanes, alleys, roads or ways whatsoever in said county, or in
any city or town along said route, the consent of the County
Commissioners of Montgomery county first being obtained,
and over and along any private property, the consent of the
owners thereof being obtained.
