CHAP. 381.

however, that said corporation shall in all respects be subject
to the provisions of chapter one hundred and twenty-three of
the Acts of the General Assembly of 189S and all ordinances
passed by the Mayor and City Council of Baltimore, and shall
be subject in every respect to the control of the Mayor and
City Council of Baltimore, in so far as its operations may be
carried on in the city of Baltimore, and nothing herein con-
tained shall be construed to the contrary ; provided, however,
that said corporation shall not grade its road or lay its tracks
or erect its poles or string its wires along, under or over the
streets, lanes and alleys of Frederick city, without first
obtaining the consent of the Mayor and Aldermen of
Frederick.

Condemn and
acquire
land.

SEC. 6. And be it further enacted, That if the said company
shall, in the construction of its said road, or of any of the
lateral or branch roads thereof, provided for in section 5 of
this Act, find it necessary to procure a right of way for its
tracks, or for the necessary freight and passenger rooms, ticket
offices, power houses, stations or depots, and shall be unable to
procure the same by agreement with the owner or owners
of land necessary therefor, then the said company may
proceed to condemn and acquire the same or the use thereof
for the purposes of said railway, in the manner provided for
in the General Laws of this State as now in force or as they
may be hereafter enacted, so far as the same may be appli-
cable, and may condemn lands, easements, rights, ways,
materials and privileges for the purposes of the company in
the manner aforesaid, and shall have all other rights, privileges
and powers which are granted by the general laws or special
laws of any county, city or town through which the said road
may pass, so far as the same do not conflict herewith.

Books open
for
subscription.

SEC. 7. And be it enacted. That the said board of directors
are hereby authorized to open books for subscription to the
capital stock of said railway company at such times and places
as they may deem proper, and that the said board of directors
shall have power to determine in what instalments said sub-
scriptions to said capital stock shall be paid.

Authority to
lease or sell
its property.

SEC. 8. And be it enacted, That the said railway company
be and it is hereby authorized and empowered to lease or sell
its properties and franchises to any other company which may
owu and operate a line of railway operated by electricity or
any other improved method of transportation, connecting with
but not parallel to the road of said corporation, for such period
and upon such terms and conditions as may be approved by its
stockholders ; and also that said railway company may lease or
purchase the lines, properties and franchises of any other com-
