ways may first be obtained ; and for the purpose of obtain-
ing rights of way, where said company cannot agree
with the owner, or when the owner is feme covert, under age,
non compos mentis, or under any other legal disability, said
company may proceed to condemn and acquire the use thereof
in the manner provided in Article 23 of the Code of Public
Laws; and said company is further authorized to construct,
lay, erect and operate in Kent and Cecil counties lines of
wire, tubes, poles, conduits and other appliances necessary to
supply, use and furnish electricity, electrical currents and
power for all commercial purposes; and (o charge and collect
such rents, rates and charges for the use thereof as may be
agreed upon ; and is authorized to transact any business to
which electricity may be applied, within Kent and Cecil
counties, State of Maryland. The railroad permitted to be con-
structed under the provisions of this Act shall be completed
within the time of four years from the passage of this Act,
otherwise the powers and privileges conferred and granted
under this Act are hereby declared to be null and void and
repealed.

CHAPTER 358.
AN ACT to add certain new Sections to Article 39 of the
Code of Public General Laws, "Fish and Fisheries,"
sub-title "Trout and other Fish," to follow Section 78 of
said Article, and to be designated Sections 78 A, 78 B, 78 o,
78 D, 78 E, 78 F, 78 G, 78 H.

CHAP. 857.

May condemn
land, etc.

WHEREAS, It is desirable to secure greater uniformity in
the laws of this State governing the protection and increase
of the food fishes in all the waters of this State, above the
point where the tide ebbs and flows, in order to a more
equitable and effectual enforcement thereof,

Preamble.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That certain new sections be and the same are
hereby added to Article 39 of the Code of Public General
Laws, title "Fish and Fisheries," sub-title "Trout and other
Fish," to follow section 78 of paid Article, to be designated
sections 78 A, 78 B, 78 C, 78 D, 78 E, 78 F, 78 G, 78 H, and to
read, respectively, as follows :

78 A. No person shall catch or in any manner take or kill
in any waters of this State, above a point where the tide ebbs
and flows, any black base, pickerel or pike perch, otherwise
known as wall-eyed pike, and California salmon, between the
