Proviso.

citizens of Washington County," be and the same is hereby
repealed ; provided, however, that the repeal of said Act shall
in no manner effect or impair the validity of the stock sub-
scribed for or issued in pursuance of said Act, it being the
purpose of this section only to rescind and repeal that pro-
vision of said Act of 1866 which requires two of the directors
of the said Western Maryland Railroad Company to be
citizens of Washington county.

Section 5. And be it further enacted. That the provisions

of this Act are made and enacted to be effective only in the
event that a sale shall be made by the Mayor and City Council
of Baltimore of its interest in the Western Maryland Railroad,
and upon the conditions that any purchaser or purchasers of
the interest of the said Mayor and City Council of Baltimore
in said railroad, shall, at the time of the purchase of said city's
interest therein, also purchase the interest of Washington
county therein at a price or sum which shall be in the same
proportion to the price or sum to be paid by such purchaser or
purchasers for said city's interest as the investment of Wash-
ington county in said railroad bears to the investment of the
Mayor and City Council of Baltimore therein, upon the same
basis of calculation, and a tender by said purchaser or pur-
chasers of said price or sum, calculated as aforesaid, to the
Board of County Commissioners of Washington county shall
be deemed a fulfillment and performance of said further
express conditions, and upon such tender the provisions
of the preceding section of this Act shall be in full
force and effect; provided, however, that if the Board of
County Commissioners of Washington county shall have abso-

lutely and unconditionally sold and disposed of its interest in
the said road before the Mayor and City Council of Baltimore
shall have sold and disposed of the interest of Baltimore city
therein, then and in that event the provisions of this section
shall not apply to the purchaser of the said city's interest ; and
provided, further, that if at the time of the purchase by any
purchaser of the interest of the said city in said railroad the
said County Commissioners of said county shall not have
absolutely and unconditionally sold and disposed of the interest
of said county in said road, then and in such event the pur-
chaser of the interest of said city shall be required to pay or
tender to said County Commissioners the price or sum for the
said county's interest, as is hereinbefore stated and provided.

SEC. 6. And be it further enacted, That the purchaser 'or
purchasers of said interests of the Mayor and City Council of
Baltimore and of Washington county in the Western Mary-
land Railroad Company shall covenant and agree with the
