CHAP. 127.

Authorized
to borrow
money.

175. The Mayor and City Council are hereby authorized
and empowered to borrow, on the faith and credit of the city,
any sum or sums of money, not exceeding in the aggregate
five thousand dollars, and may issue bonds or other evidences
of indebtedness for the same, and in such sums and payable
at such time as they may by ordinance prescribe; provided,
however, that at no time or times shall the Mayor and City
Council borrow any sum or sums of money exceeding in the
aggregate five thousand dollars, without first obtaining the
consent of a majority of the legally qualified voters of said
city, except the bonds herein specially provided for in sections
152 A. and 175 A ; any bonds or other evidence of indebtedness,
claim or demand for any sum or sums of money in excess of
the sum of fire thousand dollars, as aforesaid, hereafter issued
or existing on account of any sum or sums of money borrowed
by said city in excess of the aforesaid sum of tive thousand
dollars, without having first obtained the consent of a majority
of the legally qualified voters of said city, as aforesaid, shall
be absolutely void and of no effect, and shall be unenforceable
in the hands of the holder or holders thereof, whomsoever he
or they may be.
175 A. Whenever the Mayor and City Council of Havre de

provided for, shall determine to purchase or erect any gas
plant, electric light plant, water plant, or system of sewers,
for said city, they are hereby authorized and empowered to
borrow on the credit of the said city a sum of money necessary

for such purchase or erection and to issue bonds therefor, and
said bonds shall be issued in the manner and under the same
terms and conditions as to form, maturity, redemption, payment,
einking fund and other particulars, as is in this Act provided
for the issue of bonds for the liquidation of the present float-
ing debt of said city ; provided, however, that the total bonded
and floating indebtedness of said city shall at no time exceed
four per centum of the taxable basis of said city.
175 B. Whenever the Mayor and City Council shall, by

construction of any parks, public square, sewer or system of
sewers, water works, gas works, bridge, wharf, or other public
improvements, the Mayor shall, by and with consent of the
Council, appoint three of the legal voters and freeholders of
the city not office holders, who, together with the Mayor and
City Attorney, shall constitute a commission, to examine and
report on the proposed improvements ; and if the said com-
mission, or a majority of them, shall certify to the Mayor and
