CHAPTER 82.
AN ACT to authorize the Baltimore and Delaware Bay Rail-
road Company to change the northern terminus of its rail-
road from the present point on the bounday line between
this State and the State of Delaware to the point of inter-
section with the Townsend Branch of the Delaware Railroad
Company ; to discontinue operation of and abandon the
small portion of its railroad between said points; and to
lease or sell and convey, either or both, the remainder of its
railroad and property and franchises exercisible in connec-
tion therewith to the Delaware Railroad Company ; and to
authorize the Delaware Railroad Company to become lessee
or purchaser thereof.
WHEREAS, The Baltimore and Delaware Bay Railroad Com-

pany is a corporation duly constituted under the laws of the State
of Maryland, and is authorized to own and operate a railroad
located wholly within the county of Kent, in said State; and
WHEREAS, The Delaware Railroad Company is also a cor-

poration existing under the laws of Maryland, owning, inter
alia, a railroad known as its Townsend Branch, which is in-
tersected by said Baltimore and Delaware Bay Railroad
Company's railroad at or near Massey's, in said last-mentioned
county ; and
WiiEREAS, By changing the northern terminus of said

Baltimore and Delaware Bay Railroad to its present point of
intersection with the said Townsend Branch of the Delaware
Railroad Company, its continued operation, in direct connec-
tion with, and as part of, said Delaware Railroad Company's
system, would be assured, and the public interests substantially
promoted by the direct and expeditious transportation facilities
thereby afforded to Baltimore and other commercial centres
and markets; therefore,
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Baltimore and Delaware Bay Railroad

Company be and it hereby is authorized and empowered, with
the consent of the holders of at least three-fourths of its
capital stock, given as hereinafter provided, to change the
northern terminus of its railroad from the point on the boun-
dary line between this State. n.nd the State of Delaware to the
present point of intersection with the Townsend Branch of the
Delaware Railroad Company at Massey's; and to abandon
and discontinue the operation of the small portion of said
railroad lying between the said points, and to remove the rails,
ties and other material therefrom, and either sell the same or
make use thereof elsewhere on its said railroad.
