146 A of Article six and 116 A of Article twenty-one. It shall
be unlawful for any person, except actual bona tide residents
of Caroline and Talbot counties, and they shall first obtain
permission of the occupants or owners of the lands bordering
on the waters hereinafter mentioned, to take or catch fish in
the waters of the Great Choptank river above the mouth of
Linchester river, and in Tuckahoe river, with seines with
meshes of less size than five inches square.

146B of Article six and 116 B of Article twenty-one. It shall
not be lawful for any person to take or catch fish in the waters
of the Great Choptank river above the mouth of Linchester
river and in the waters of Tuckahoe river, with haul seines,
float seines or other devices, except hook and line, between the
fifteenth day of May and the first day of August in each and
every year, and during the season when the taking and
catching of fish is allowed, as aforesaid, it shall be unlaw-
ful for any person to keep, put or allow his, her or their
haul-seines, float seines or other devices, except hook and line
to be in or used in any of the waters aforesaid, between
the hours of two o'clock P. M. on each and every Satur-
day, and twelve o'clock midnight on the following Sun-
day night, or for any person to set, place or use in the
waters aforesaid, for the purpose of taking or catching fish, at
any time, any pound nets or weirs, or any fykes, the outer or
outside opening or mouth of which is more than two feet in
diameter, and any person violating any of the provisions of
this or the preceding section shall be deemed to be guilty of a
misdemeanor, and upon conviction thereof, before any justice

of the peace in and for either of said counties, having jurisdic-
tion in the premises, shall be fined not less than five dollars
nor more than fifty dollars, for each and every offense, or shall
be subject to a forfeiture of the seines, boats and appurtenances
thereto belonging, or both fine and forfeiture in the discretion
of the justice; provided, however, that the accused shall have
a right to pray a jury trial or take an appeal to the Circuit
Court of the county wherein the accused was arraigned as in
other criminal cases of the same grade, upon giving the usual
bonds required in such cases.

Repeal.

146 C of Article six and 116 o of Article twenty-one. That
all acts or parts of acts, in so far as they relate to the taking
and catching of fish in the waters of the Great Choptank river
above the mouth of Linchester river, and to the waters of
Tuckahoe river, inconsistent with the provisions of this act, be
and the same is hereby repealed.
