performance of the duties of their office. The duties of the
nnder-bailiffs, when appointed, shall be to assist the chief
bailiff, and they shall be subject to his order and directions; for
that purpose they shall have all the power and authority herein
conferred on the chief bailiff.

SEC. 27. And be it further enacted, That the Mayor shall

have all the power of a justice of the peace, in criminal cases
where the Mayor and Council are a party, and shall receive
the same fees as allowed justices of the peace, in similar cases;
and an appeal from his decision, when the demand or fine
exceeds five dollars, may be taken to the Circuit Court for the
county, which shall determine the matter, as upon the appeals
from the justices of the peace.

SEC. 28. And be it further enacted, That the chief bailiff
shall have the same fees for making distress for taxes as are
allowed county collectors; and for making arrests or serving
process for violating any ordinances of the corporation, the
same fees are allowed constables for similar services; and
when the bailiff fails to discharge any of the duties of his
office, he may be fined not exceeding ten dollars for any one
offense.

SEC. 29. And be it further enacted, That any fines, penal-
ties or forfeitures imposed by this charter or by any ordinance
of the council may be collected by proceedings in the name of
the Mayor and Council, before the Mayor or justice of the
peace; and the said Mayor or justice of the peace shall have
the power to commit the offender to the lockup or county jail,
on failure to pay such fine and forfeiture, until the same shall
be paid with cost.

Recovery of
penalties.

SEC. 30. And be it further enacted, That the council shall
not expend, or contract to expend, in any one year, more money
than the amount receivable from taxes and other services for
that year.

Limit to ex-
penditures.

SEC. 31. And be it further enacted, That that part of the
several county roads within the limits of said town are hereby
declared to be public streets and avenues of said town, and
shall be, from time to time, improved and repaired as, in the
discretion of the council, the public interests of the town
may require and the resources of the town will permit and
justify.

SEC. 32. And be it further enacted, That the council shall
keep and annually publish a tabular statement of the receipts
and expenditures of the funds of the corporation.
