LLOYD LOWNDES, ESQUIRE, GOVERNOR.
CHAPTER 311.

AN ACT to grant the Washington, Woodside and Forest Glen
Electric Railway and Power Company the right to acquire
land by condemnation for right of way and other proper
purposes.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Washington, Woodside and Forest Glen Elec-

tric Railway and Power Company of Montgomery County,
Maryland, in the event that it cannot acquire by gift, purchase
or agreement, the right of way for its road over and along the
route which it has selected or may select; or in the event that
any of the owners of the land or property, or rights of way
sought to be acquired, be a body corporate, a married woman,
an infant, non compos mentis, a non-resident, or unknown, then,
and in either of such events, the said corporation may acquire
such right of way or other property necessary to its purposes,
by condemnation. It may also acquire by condemnation the
right to cross the right of way and property of any individual
or body corporate at such point as the said Washington, Wood-
side and Forest Glen Electric Railway and Power Company of
Montgomery County, Maryland, may deem advisable. For the
purpose of such condemnation the said company is hereby
clothed with the said right of condemnation under the State's
right of eminent domain, as is provided by section 167 of Article
23 (title " Corporations,") of the Code of Public General Laws,
and the manner of proceedings in such condemnations shall be
in all respects in conformity to the provisions of said section
167 of Article 23 of the Code of Public General Laws; pro-
vided, however, that nothing contained in this act shall be con-
strued to empower the said Washington, Woodside and Forest
Glen Electric Railway and Power Company to condemn any
portion of the roadway of the Union Turnpike Company, save
and except for the purpose of a crossing.

from the date of its passage.
