as the same may be applicable, so much real estate as may be
necessary for the erection of such building, and they shall also
have power to build a lock-up, to be used for the purposes of
said corporation, the cost of which shall not exceed one hun-
dred and fifty dollars, and they shall have power to levy and
collect taxes to carry out the provisions of this section.

370. The commissioners may appoint annually a water
superintendent and a lamp lighter, whose duties and compensa-
tion, as well as the compensation of all other officers whose
appointment by the said Commissioners is provided for by this
article, shall be prescribed by ordinance.

371. The Burgess and Commissioners shall have full power
and authority to authorize and permit, and by ordinance to
grant, to any railroad company whose road enters or is
intended to enter the limits of the corporation of Middletown,
the right and privilege of laying down and constructing its
tracks, and of building and grading its road along, through
and over any of the streets, lanes and alleys of said town,
subject to such regulations as may be provided by ordinance.
The said Burgess and Commissioners shall also have power by
agreement with the owners or proprietors of the turnpike road,
running through said town, to take charge of and keep in
repair so much of said turnpike road as lies within the taxable
limits, as one of the streets of said town.

SEC. 2. And be it enacted, That nothing in this act con-
tained shall be construed to impair or affect any right or contract
of the Burgess and Commissioners of Middletown heretofore
acquired or made; but all rights, suits, claims, demands, con-
tracts or obligations existing and pending at the time of the
passage of this act, shall remain in full force and effect; and
the Burgess and Commissioners of Middletown now in office
under the provisions of the sections of the law repealed and
re enacted by this act, shall remain in office, with full authority
to assert, prosecute and defend all such pending rights, suits,
claims, demands, contracts or obligations, and to exercise all
the powers and duties of Burgess and Commissioners under
the provisions of this act, until their successors are elected and
qualified, as hereinbefore provided, and with full power to col-
lect all taxes heretofore assessed and levied within the said
taxable limits of said corporation and remaining unpaid at the
time of the passage of this act.
