CHAP. 95.

they are employed, in carrying into effect the provisions of
th s law, and that the collector of the city of Baltimore, shall
be allowed three per cent on all sums collected by him, under
the provisions of the law, which per diem, advertising, locat-
ing and commissions, are to be considered as a part of the ex-
pense for the carrying of this law into execution, and are to
be assessed and levied as herein before mentioned.

Damages to be first
paid

Sec. 6. And be it enacted That the said street shall not be
considered to be opened and extended, until the damage to be
by such persons sustained, and assessed as aforesaid, shall
first be paid to the mayor and city council of Baltimore, for
the use of the person or persons entitled to receive the same.

Act of 1825 repeal-
ed-conditionally

Sec. 7 And be it enacted, That the act of the General As-
sembly of Maryland, passed December session, eighteen hun-
dred and twenty-five, entitled an act, for the relief of Solo-
mon Etting, of the city of Baltimore, with all his rights and
privileges of recovering under the same, be, and the same is
hereby repealed; but if the said street be not opened within
one year after the passage of this act, that then said act for the
relief of Solomon Etting, shall be and remain in full force and
effect, any thing to the contrary herein contained notwith-
standing.

Act of 1826 repeal-
ed.

Sec. 8. And be it enacted, That the act of the General As-
sembly of Maryland, passed December session, eighteen hun-
dred and twenty-six, entitled an act to open and extend Pine
street, in the city of Baltimore, be and the same is hereby re-
pealed.

Approval of the

SEC. 9. And be it enacted, That no proceedings shall take
place under the within act, until the same shall have been ap-
proved by the mayor and city council of Baltimore.

An act relating to public roads in Talbot county.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the justices of the levy court for the county afore-
said, or a majoiity of them, be, and they are hereby authorised
and required to meet together on the first Monday of April
next, and on the same day in every year thereafter, at the court
house in said county; and when so met together the said justi-
ces, or a majority of them, shall be, and they are hereby autho-
rised and required (if not already clone to their satisfaction) to

describe, ascertain, and distinctly record in a well bound book,
to be (if necessary provided by them for that purpose, the
several and respective roads and public highways as now es-
tablished in the said county, and to nominate and appoint ca-
