CHAP, 81

Neglect of duty

tion, any one of the said commissioners is hereby authorised
to administer, and the said clerk shall be subject to the same
penalties and forfeitures for non-perform ance or neglect of
official duty, as are prescribed by the existing laws, in rela-
tion as well to the several matters and things which the clerk
of the county court of said county may be legally directed,
and required to perform, under the authority of the levy
court, as likewise to those which appertain to the office of
the present clerk of the commissioners cf the tax for said
court.

SEC. 6. And be it enacted, That in case of a vacancy oc-
curring in the office of clerk to the commissioners as created
by this act, in consequence of death, resignation removal or
disqualification, the same shall be supplied supplied as soon
thereafter as may be practicable in the manner prescribed

SEC. 7. And be h enacted, That the said clerk of the com-
missioners to he appointed in virtue of this act as aforesaid,
shall be entitled to receive as compensation for his services
such sum annually, as the said commissioners may direct, not
exceeding the sum of three hundred dollars, to be levied on
the assessable property of said county, collected and paid

over as the other county charges,
SEC. 8. And be it enacted, That upon the appointment of
a clerk to the commissioners as aforesaid, the clerk of Har-
ford county court shall upon demand of said clerk to the com-
missioners, by the order of the said commissioners, forthwith
deliver over to the said clerk of the commissioners, all the
books, accounts, papers and documents, belonging to, or in
any manner appertaining to the said levy court of said county,
and shall annually, on or before the second Monday of June,
furnish to, and lay before the said commissioners, all copies
of such lists, accounts, papers and documents, as may be use-
ful and necessary to the said commissioners in ascertaining
the county charges, and according to the directions which he
may from time to time receive from the said commissioners,

Compensation

for which services he shall have and receive such fees as by
law he is entitledto for like services; and in case said clerk of
Harford county court shall neglect or refuse to comply with
any of the provisions or requisitions contained in this act,
when called on by the said commissioners, or the clerk there

Penalty for neglect

of by their order thereafter, he shall, for every such neglect
or refusal, forfeit and pay the said commissioners, for the use
of the said county, the sum of one hundred dollars, to be
recovered by indictment or action in Harford county court.

Book cases

SEC, 9. And be h enacted, That it shall be the duty of the
members of commissioners, at their first meeting, or within
one month thereafter, to appoint some proper person to erect,
or cause to be erected, and fitted up in the same room where
the commissioners of the tax keep their books and papers, a
suitable book case, in which the books, papers and documents
belonging to the commissioners may bt; safely deposited and
kept.
