SEC. 4, And be it enacted. That said superintendents of
free schools, shall make all necessary rules and regulations for
the government of the schools, created by this act; and shall
purchase books, stationary and fuel for the use of said schools,
provide school houses, visit and examine into the condition of
said schools, at least once in every three months; dismiss any
teacher for incompetency, improper conduct or other satisfac-
tory cause, and appoint a successor; pay the salaries of the
teachers, and all incidental expenses by orders on the register
of the town, signed by their president, and shall annually in
the month of April, report to the corporation of Frederick,
the number of pupils in such school; the amount of money
paid for teachers and incidental expenses, and shall make an
estimate of the probable expenses which will be incurred in

the next ensuing year.
Sec. 5. And be it enacted, That in case of the death, resig-
nation or refusal to serve, of any Superintendant of free
schools herein appointed, or who may be hereafter appointed,
the aldermen and common council of Frederick., shall proceed
to fill the vacancy thereby occasioned, at their first meeting
after such vacancy shall have occurred.

SEC. 6. And be it enacted That all such white minors,
residing within the taxable limits oi Frederick, as may apply
to either of said superintendants of free schools, to be gratui-
tously educated, shall be at liberty to become pupils in the
schools of their respective school districts, free of all charge
whatsoever.

SEC. 7. And be it enacted, That, that portion of the school
fund of Frederick county, heretofore directed by act of assem-
bly to be paid annually to the president and directors of the
Fredericktown free school, shall hereafter be paid in like wan-
ner, to the register of Frederick, tor the use of the schools
hereby created.

SEC. 8. And be it enacted, That the said superintendants
of free schools, shall have power to admit pupils other than
those provided for in the fifth section of this law, into the said
schools on such terms and conditions, and the payment of
such tuition money as they shall think just. All monies re-
ceived for the instruction of such pupils, to be paid by said
superintendants to the register of Frederick, and constitute a
part of the school fund created by this act.

SEC, 9 And be it enacted That seven superintendants of
free schools, snail, at all meetings, be deemed a sufficient
number, to transact any business required to be performed
by said superintendants, under this act.

Quorum.
|
SEC. 10. And be it enacted, That all acts, or parts of acts of
assembly heretofore passed, inconsistent with or repugnant
to the provisions of this act; be, and the same are hereby re-
pealed.

SEC. 11. And be it enacted, That if the Rev'd. John Mil-
roy shall annually in the month of March, report to the super-
intendants of free schools for the city of Frederick, the num-
ber of white minors, residents within the taxable limits of Fre-
