timore, which reimin uncollected, shall, when collected, be
.paid to the treasurer of Baltimore county, appointed by the
commissioners of said county; and all such part or parts of the
said county tax, as has or hive been collected by the collectors
heretofore appointed for that purpose, and remaining in their
hands, shall be paid by the said collector or their representa-
tives to the said Treasurer, and shall by him be paid and
applied under the direction of the commissioners of Balti-
more county, to the purposes and objects for which the same
were originally levied. And the said commissioners of Bal»
timore county, shall have the same powers to enforce the col-
lection and payment over by the collectors, of the said coun-
ty tax, as were heretofore exercised or possessed by the justi-
ces of the levy court of Baltimore county, to all intents and
purposes whatsoever, and all monies in the hands of the
clerk of Baltimore city court, and which he shall hereafter re-
ceive, made payable by law to the justices of the levy court
of Baltimore county, or applicable to the payment of the re-
pairs and expenses of the jail and other joint charges of the
said city and county of Baltimore, after deducting commis-
sion at the same rate which the said clerk is authorised to re-
tain, for monies received by him for the state, shall be bv the
said clerk divided, apportioned and paid over as follows:
That is to say, two fifths of the amount of such monies to
the treasurer of Baltimore county, for the time being, to be
by him, applied under the direc ion of the commissioners of
Baltimore county, to the payment of the said joint expenses
anci charges; and the remaining three-fifths to the Mayor and
City Council of Baltimore, to be applied by them to the pay-
ment of the said joint charges and expenses.

CHAPTER 33.

 

An act to provide for the valuation and condemnation of wa-
ter at the mouth of Windsors creek , in Somerset county
for the erection and establishment of a Tide Mill.

Passed February 1

1828,

WHEREAS, Arthur Dashiell, of Somerset county, has by
his petition to this General Assembly represented, that the
erection and establishment of a tide mill, at the mouth of
Windsor's creek in said county, would conduce to the benefit
of the citizens of Somerset and the neighboring county, and
it appearing that this representation is correct, and whereas,
it also appears that such a mill cannot be erected unless said
Dashiell have relinquished to him the right of the state to the
water of said creek, and the land which it covers as far as low
water mark, Therefore

Preamble.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That all the right and interest of the state, in and to the
water of Windsors creek in Somerset county, at the mouth of
said creek, as far as low water mark, and the adjoining the land
