such damages sustained thereby, to the owner or owners
thereof, as shall be awarded by two respectable disinterested
men of the vicinity, under their oath or affirmation, who may
be summoned to view the same and In case of their disagree-
ment, it shall he lawful for the party or parties aggrieved, to
cause a third man to be summoned, who shall qualify as above
required, and the decision of any two of them shall be final;
the said damages to be recovered in the same manner as is
or shall be prescribed for the recovery of debts.

CHAP. 150

SEC. 4. And be it enacted, That the fees of officers for duties
performed under this act shal be the same as allowed by
law for duties of the like nature, in cases of debt.

Sec. 5, And be it enacted, Fhat all laws or parts of laws
inconsistent with, or repugnant to the provisions of this act,
so far as the same relates to Charles county, be, and the same
are hereby repealed

CHAPTER 151.

 

An act for the payment of the journal of accounts.

Passed March 11,

1823.

WHEREAS, it appears by the journal of accounts of this
session, that there is due from this state the sum of thirty-
seven thousand and fifty-seven dollars and fifty and a half
cents: Therefore,

Preamble.

Be it enacted by the General Assembly of Maryland, That
the treasurer of the Western Shore be, and he is hereby au-
thorised and required to pay the several persons, their execu-
tors, administrators, assigns or orders, or to such of them as
shall offer to receive the same, the several sums of current
money allowed to them respectively, as they appear to be
settled and ascertained by the said journal of accounts, out
of any money now in the treasury, or that shall come into the
treasury, subject to the appropriation of the General As-
sembly.

CHAPTER 152.

 

A supplement to the act, entitled, an act for the re-valuation of
the real and personal property in Cecil county.

Passed March 11,
1828

Be it enacted by the General Assembly of Maryland, That
the following persons be, and they are hereby appointed com-
missioners of the tax for Cecil county, instead of the persons
named in the original act to which this is a supplement, viz.
John Jordan, Robert Evans, John C, Cazier, Davidson D.
Pearce and John H. Lusby, and the said persons shall have
and be vested with all the powers that were vested in the
commissioners named in the original act to which this is a
supplement.
