1828,

An act to ascertain and establish the termination of the main
road leading from William J, Ford's' s store, in Dorchester
county, at a place called and known by the name of Castle ,
Haven the property oj Levin Jones, of said county.

Commissioners to
ascertain

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Vernon Creighton, James Pattison, ( Town Point)
and William J. Ford, be, and they are hereby appointed com-
missioners to ascertain and establish the termination of the
main road leading from William J. Ford's store, in Dorches-
ter county, at a place known and called by the name of Castle
Haven,

Return proceed-
ings-ratified if not
set aside

SEC. 2. And be it enacted, That the said commissioners shall
and it is hereby made their duty, to make return of their pro-
ceedings to the clerk of the county court of Dorchester, at
least three months before the October term of eighteen hun-
dred and twenty eight, and if no objections be filed before the
end of said term, or any being filed shall be set aside as here-
inafter provided for, then, and in that case, it shall be lawful
for the clerk of said county court to record the said proceed-
ings amongst the records of said court, and the road so as-
certained and established by authority of this act, shall hence-
forth be deemed and considered a public road, and kept in
repair as other county roads.

Court to hear and
determine

SEC. 3. And be it enacted, That if any objections be filed
to the said proceedings, it shall be lawful for the judges of
said court to entertain and hear the same, and determine the
merits thereof, according to the right and equity of the mat-
ter, with discretion hereby given the said judges to fix the

costs accrued in the prosecution of said caveat proceedings,
upon such party as the said judges shall deem proper tu pay
the same.

Compensation to

commissioners

Sec, 4. And be it enacted, That the said commissioners
shall respectively be allowed at the rate of two dollars per
day for each and every day they shall be engaged in the es-
tablishment of said road, and the same to be paid by Levin
Jones, of Castle Haven.

Authority to col-
lect compensation

SEC. 5. And be it enacted, That the said commissioners
shall have the benefit of the laws for the recovery of small
debts out of court, for the recovery of such com pensation as
they shall be entitled to receive, fay virtue of this law.

Clerks, fees

SEC. 6. And be it enacted, That if said proceedings shall
be recorded by the clerk or said county court, he shall he al-
lowed therefor at the same rate as now established by law, in
the case of other records, the same to be recovered of the said,
Levin Jones as other officer's fees.
