night-time or frequenting the houses of other persons in said
village, without the permission of their masters, mistresses or
overseers.

CHAP. 106,
|
S. A/ad be it enacted, That it shall not he lawful for any
person or persons to keep or raise any geese or swine within
the limits of said village, except in pens or other inclosurcs, and
if any geese or swine are found going at large within the limits
of said village, belonging to any person or persons whatsoever,
it shall and may be lawful for the bailiff of said village, upon
information of any of the inhabitants thereof, or upon his own
view, to seize all such geese and swine, and to secure the same
in some common pound, and them safe keep until the owner or
owners thereof, if known, shall be informed by said bailiff; and
the bailiff shall receive for his trouble fifty cents for every hog,
and fifty cents for every dozen geese, and a proportionate sum for
every goose, so seized and impounded ; and if the owner or
owners of such geese and swine shall neglect or refuse to pay
the aforesaid sum within two days after having notice of such
seizure, it shall and may he lawful for the said bailiff to sell the
same at public sale in said village, between the hours of twelve
and three o'clock in the evening, after giving three days public
notice in said village, and to pay two thirds of the money arising
from said sales over to the said commissioners, to be applied by
them to defray the expenses of improving said village.

9. And be it enacted, That the said commissioners, or a ma-
jority of them, shall on the second Mohday of April next, or as
soon thereafter ss may be convenient, nominate and appoint
person of good repute and skill to be clerk to the said commis-
sioners, whose duty it shall be to keep a fair and faithful record of
all their proceedings, by virtue of this act, in a book to be pro-
vided for that purpose by the said commissioners, which proceed
ings shall be subject to the inspection and examination of the in
habitants of the said village, and of all persons who may be con
cerned in said proceedings; and the said commissioners shall al-
low their clerk such compensation for his services as they may
think right and reasonable, to be paid out of the money arising by
virtue of this act,

10. And be it enacted, That if any person or persons shall
refuse or neglect to pay the taxes, fines and forfeitures, respect
tively charged against them by virtue of this act, it shall and may
be lawful for the commissioners to collect the same in the same
manner, and with the same costs, that small debts are collected
out of court; and in case there may be found real or personal pro-
perty within the village of Denton, and the owner or owner
thereof being resident, or of some other county, then and in that
case the commissioners shall have full power and authority to
sell so much of said property as will satisfy the sum or sums so

due and owing by the owner of said property; Provided, that
before the said commissioners shall proceed to sell any property
of any person or persons who shall be resident of any other
county, it shall be the duty of the collector to call on the tenant
(if any lives on the property,) and on his refusal or neglect
pay, the commissioners are hereby authorised to give notice
some news-paper, if any printed in the county where said owner
