distinctly to specify such property, and the sum allowed as da-
mages therefor shall remain in the hands of the mayor and city
council of Baltimore, to be paid over by them, without interest,
to the person or persons entitled to receive the same, so soon as
a legal decision may be had thereon.

CHAP. 87,

7. And be it enacted, That each of the said commissioners
shall, on or before the expiration of one month after the approv-
al of this act by the mayor and city council of Baltimore, as
is hereinafter provided, take the following oath, (or affirmation,)
before some justice of the peace: "I, A B, do solemnly swear,
(or affirm,) that I will forthwith, and to the best of my ability,
execute the duties assigned to me by the act, entitled, An act
for the opening of Ensor street in the city of Baltimore, with-
out favour or partiality;" and if any of the said commissioners
do not, on or before the expiration of one month after the ap-
proval of this act by the mayor and city council aforesaid, take
said oath, (or affirmation, ) he or they shall be considered as hav-
ing resigned, and it shall be the duty, in such case, of such of
the said commissioners herein before mentioned, as may qualify,
forthwith to appoint one or more persons to supply such vacan-
cy in said board.

8. And be it enacted, That it shall not be required by the
owner or owners of any building or buildings already erected on
the east side of said street, between Forest-street and a lot of
ground belonging to Archibald Stirling, which said building or
buildings, or part thereof, may be within the said street, so open-
ed, or to be opened, to remove, or cause the same to be remov-

ed; Provided, however, that any building or buildings that may
hereafter be erected on any part of said street, shall be erected
in conformity with the lines of said street as located pursuant to
this act.

Proviso.

9. And be it enacted, That the said mayor and city council
shall pay, or tender in payment, to the parties entitled to receive
the same, the damages sustained, or which shall be sustained,
by any person or persons, by reason or on account of the open-
ing the said street, as the same may be assessed or ascertained
by said commissioners, within thirty days after the lists made
out by the said commissioners, (in conformity with the provi-
sions of the third section of this act,) shall have been deposited
in the office of the register of the city of Baltimore.

10. And be it enacted, That in case any person or persons,
on whose property is assessed any sum or sums of money, shall
voluntarily pay the same into the treasury of the city of Balti-
more, at any time before the expiration of thirty days after the
return of the commissioners shall be made to the register of said
city, (in the mode prescribed by the third section of this act,)
such person or persons shall be entitled to a deduction of the
commission which may have been allowed to the collector by the
said commissioners, in virtue of the provision in the said fifth
section.

11. And be it enacted, That the city collector, before en-
tering upon the duties required of him by this act, shall give
bond to the corporation of the city of Baltimore, with sureties,
to be approved by the mayor, and the presidents of the two
