1826.

3. And be it enacted, That in case of the death of any such
infant or infants, before their arrival at lawful age, or his, her,
or their death without lawful issue, the proceeds of the said
sale shall be considered as real estate, and as such shall descend
to those heirs or representatives who would be entitled to the
said lands, in the same manner as if the same had not been sold
in virtue of this law.

An Act relating to Revolutionary Officers and Soldiers, and their Widows.

Be it enacted by the General Assembly of Maryland,
That the treasurer of the western shore be and he is hereby au-
thorised 2nd empowered, to restore to the pension list, any
pensioner or pensioners who may have been stricken off the
said pension list under the provisions of the resolution number
twenty- six, passed at December session eighteen hundred and
twenty-three, and also to pay him or them, or their order, any

balance that may appear to be due; Provided, that such pen-
sioner si tall prove upon oath, or affirmation, to the satisfaction
of the said treasurer, that he is the identical person who was
originally placed on the pension list of the state of Maryland.

An Act relating to certain Property of Rebecca Smith, of Baltimore Coun-
ty.

Passee Mar 9, 1827

WHEREAS it is represented to this general assembly, by the
petition of Rebecca Smith of Baltimore county, that a valuable
property has been vested in trustees for her separate use and
benefit, during her life-time, and after her death for the benefit
of her children, and that it would be highly beneficial to her
and her said children if the said trustees, or such other persons
as she might be authorised to appoint, were enabled to sell the
said property, and invest the proceeds of such sale in some safe
and productive fund subject to the same trust; Therefore,

Preamble

1. Be it enacted by the General Assembly of Maryland
That Rebecca Smith, wife of Dennis A. Smith, of Baltimore
county, shall be and she is hereby empowered and authorised
to appoint three or more trustees, by deed under her hand am
seal, acknowledged by her before one of the judges of Baltimor
county court, or two justices of the peace for the city of Balti
more, and recorded among the land records of Baltimore coun
ty court, and in and by such deed to authorise the said trustees
so by her appointed, or any two of them, to sell in such man
ner, and on such terms as she shall direct, all and singular th
ferry and ferry-landing on the Patapsco river, commonly called
Norwood's Ferry, and the lands thereto appertaining, and gene-
rally used therewith, together with all the buildings, the bridge
ways, waters, water courses, toll rights, advantages and appur-
tenances, to the same belonging, or in anywise appertaining, and
all the right, title, estate, interest and possession therein and
thereto, as conveyed by George Williams, in trust for the sepa-
rate use of the said Rebecca Smith, and her children, by inden-
ture dated the twenty -third day of December, in the year eigh-
teen hundred and seventeen, and recorded among the land re-
