count stating the taxes and the amount of fees due to the officers
respectively, or such part thereof as may be claimed as due; and
the said securities, or a majority of them, or their agent shall, if
they be thereto required by the person so charged, make oath
before a justice of the peace, tfeat the said account was taken fair-
ly and truly from the books of the said Charles Jones; and if the
person or persons owing such taxes and officers fees, shall neglect
or refuse to pay the same, it shall and may be lawful for the said
securities, or a majority of them, or the survivors of them, to
collect the same by execution or distress of property of the per-
son or persons so refusing or neglecting, and to sell and dispose
thereof at public auction, at the expiration of ten days, exclusive
of the day of seizure and the day of sale, on giving ten days no-
tice by advertisement, in writing, set up at the most public
places of the neighbourhood, and at the court-house door of the

county of the day and hour of sale.
2. And be it enacted. That all books, memorandums, and
entries of the said sheriff, and his deputies, in which his ac-
counts as sheriff and collector are stated and kept, shall be de-
livered by George Jones, of Robert, and Robert Jones, of Ro-
bert, his executors, to the said securities, or a majority of them,
on demand, and shall be deposited in the hands of such person
as the securities, or a majority of them, shall direct, in the
town of Princess Anne, to be freely inspected and examined,
without costs or charges, by any person or persons who shall

apply for that purpose, in order to ascertain any payment that
may have been made upon his, her or their account; And pro-
vided also, that the said George Jones, of Robert, and Robert
Jones, of Robert, before they shall deliver the said books, me-
morandums or entries, to the said securities, shall make oath
before a justice of the peace for Somerset county, that they,
the said George Jones, of Robert, and Robert Jones, of Ro-
bert, as executors of the said Charles Jones, have not directly
or indirectly received any part or parcel of the money which
was due and payable to the said Charles Jones, as sheriff and
collector of Somerset county, nor any security or satisfaction,
more than they have credited on the said books.

Proviso
|
3. And be it enacted, That the said securities, and the sur-
vivors of them, shall have the same commission on the collec-
tion aforesaid as the said sheriff would have been entitled to,
and that all arrearages collected by virtue of this act, shall be
fairly applied as follow, to wit: All arrearages of taxes shall be
paid over to the several persons who may have claims against
the said Charles Jones, as collector, in proportion to the amount
of their respective claims; all officers fees, other than execution
fees, to be applied to the several officers, and others, who have
claims against the said Charles Jones as sheriff, in like manner;
and all execution fees to be paid over to the executors of the

said Charles Jones, to be applied to the payment of his private
debts; Provided, that the said securities, or their agent, shall
not charge any interest on any of the balances due to the said
Charles Jones, as sheriff or collector, until the time when he was
bound to pay interest on the same.
