Ch. 102 LAWS OF MARYLAND

(8) "[In-state sending] SENDING track" means any [thoroughbred]
horse racetrack within the State that is operated by the holder of a license issued by the
Maryland Racing Commission [to conduct a horse race meeting] UNDER § 7 OR § 17
OF THIS ARTICLE and that is equipped to transmit simulcast horse races to a
receiving track and to conduct intertrack wagering on those races.

(b) (4) Upon the filing of a joint application by [an in-state] A sending track
and [an in-state] A receiving track and after the holding of a public hearing, the
Maryland Racing Commission may issue an intrastate simulcasting license to fan
in-state] A receiving track, that permits intertrack wagering during the periods of time
in the calendar year specified by the Commission under the terms and conditions that
the Commission may deem appropriate.

{3} THE REQUIREMENT FOR A PUBLIC HEARING UNDER
PARAGRAPH (1) OF THIS SUBSECTION DOES NOT APPLY TO AN
INTRASTATE SIMULCASTING LICENSE FOR INTERTRACK WAGERING
BETWEEN 2 RACETRACKS THAT:

(i) ARE OPERATED BY HOLDERS OF LICENSES ISSUED
UNDER § 7 OF THIS ARTICLE; AND

(II) INITIALLY RECEIVED APPROVAL FOR INTERTRACK
WAGERING BEFORE JULY 1, 1990.

(c) The Maryland Racing Commission may approve an application for an
intrastate simulcasting license if:

(1) The [in-state] receiving track demonstrates to the satisfaction of the
Commission that it has conducted, is conducting, or will conduct regularly scheduled
horse race meetings in accordance with a license issued by the Commission, and has
complied with the terms of the license;

(2) {/J. THE RECEIVING TRACK LOCATED IN ANNE ARUNDEL
COUNTY OR PRINCE GEORGE'S COUNTY, IN THE PREVIOUS CALENDAR
YEAR, CONDUCTED LIVE RACING ON AT LEAST 75 PERCENT OF THE
TOTAL NUMBER OF DAYS AVAILABLE TO BE AWARDED TO THE
RECEIVING TRACK IN THAT YEAR; OR

(II)THE RECEIVING TRACK LOCATED IN WORCESTER
COUNTY, IN THE PREVIOUS CALENDAR YEAR, CONDUCTED AT LEAST 65
DAYS OF LIVE RACING;

(3) (3) The [in-state] sending track receives approval of its intrastate
simulcasting agreement from the horsemen's organizations at its track; and

(3) (4) The [in-state] receiving track has received approval of its
intrastate simulcasting agreement from the horsemen's organizations at its track when
live racing is being conducted, or the horsemen's organizations from the previous live
meet if live racing is not being conducted at the [in-state] receiving track.

(d) (1) All money wagered at the [in-state] receiving track on intrastate
