CHAPTER 96
(Senate Bill 187)

AN ACT concerning

Dorchester County - State's Attorney

FOR the purpose of altering the salary of the State's Attorney for Dorchester County;
requiring that the State's Attorney for Dorchester County serve full time; and
providing that this Act does not apply to the salary or compensation of the
incumbent State's Attorney for Dorchester County.

BY repealing and reenacting, with amendments,

Article 10 - Attorneys at Law and Attorneys in Fact

Section 40(j)

Annotated Code of Maryland

(1987 Replacement Volume and 1989 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 10 - Attorneys at Law and Attorneys in Fact

40.

(j) (1) In Dorchester County, [(1)] the State's Attorney's salary [is $30,000]
SHALL BE 75 PERCENT OF THE SALARY OF A JUDGE OF THE DISTRICT
COURT OF MARYLAND.

(2) THE STATE'S ATTORNEY SHALL SERVE FULL TIME.

[(2)] (3) The County Commissioners of Dorchester County shall pay all
reasonable expenses for the conduct of the State's Attorney's office including, but not
limited to, rent, clerical and secretarial expenses, upon vouchers submitted by the
State's Attorney.

[(3)] (4) The State's Attorney may from time to time, if deemed wise or
necessary, with the approval of the judge of the Circuit Court of Dorchester County,
appoint and fix the compensation of assistant State's Attorneys who shall present such
cases to the Dorchester County grand jury and perform such other acts and duties in
relation to the grand jury, Circuit and District Court sitting in Dorchester County, as
deemed necessary.

SECTION 2. AND BE IT FURTHER ENACTED, That, pursuant to Article III,
Section 35 of the Constitution of Maryland, this Act may not be construed to extend or
apply to the salary or compensation of the State's Attorney for Dorchester County in
