Ch. 79 LAWS OF MARYLAND

Fund, and may, notwithstanding any other provision of law, appoint and employ claims
adjusters, attorneys, and other personnel necessary therefor, either directly as
employees, or on a contract basis.

(b) The executive director shall establish and maintain reasonable and adequate
reserves for the payment of claims against the Fund. The executive director shall use
the same criteria as is required for use by a private insurer in determining the amount
of reserves necessary. At least annually, the board of trustees shall review the
reasonableness and adequacy of reserves.

(c) Notwithstanding the provisions of Article 27, § 555B of the Code, if the party
being recorded is advised in advance of the recording and thereafter consents to the
recording, the executive director may authorize employees of the Fund to record any
telephone conversation relevant to an accident or claim with a policyholder, witness,
claimant, investigating officer, or other interested party who has or might have
information relevant to the accident or claim.

(D) THE FUND MAY RECOVER ALL MONEYS THAT THE FUND PAID
OUT UNDER THIS SECTION AND SUBROGATES AGAINST A RESPONSIBLE
PARTY ALONG WITH THE ACTUAL COSTS OF COLLECTION, INCLUDING
REASONABLE ATTORNEY'S FEES.

(E) THE FUND MAY RECOVER ALL MONEYS THAT THE FUND PAID
OUT UNDER THIS SECTION FROM THE RESPONSIBLE PARTY IN ANY
MANNER PROVIDED FOR BY LAW, INCLUDING THE MARYLAND TAX
REFUND INTERCEPT PROGRAM.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.

Rcgulotions

FOR the purpose of roponling certain obsolete statutory provisions relating to zoning
regulation in
areas near—the—Baltimore WashingtonInternational Airport;
providing the Maryland Aviation Administration with the authority- to adopt
regulations establishing the height limit for any structure, tree, or otfaor vogotation
from each zoning district established for the Baltimore Washington International
Airport
clarifying a certain definition; altering a certain transition zone district
height requirement; and generally relating to the Baltimore-Washington
International Airport.
