SECTION 10. AND BE IT FURTHER ENACTED, That it is the intent of the
General Assembly that salaries and related expenses attributable to the administration
of Program Open Space for the fiscal year commencing July 1, 1992 and subsequent
fiscal years shall be funded solely from transfer tax revenues and that general funds
previously utilized for administration of this Program shall be reduced accordingly.

SECTION 8 11. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.

(Senate Bill 812)

AN ACT concerning

Agricultural Land Preservation Easements - Valuation

FOR the purpose of providing that determining the value of an easement to be
purchased by the Agricultural Land Preservation Foundation; providing that the
fair market value shall be determined by the Department of General Services;
providing that the agricultural value of land shall be determined by a certain
formula, subject to the approval of the Department of Agriculture; providing that
the order of priority of certain applications to sell easements shall be determined
based on a certain ratio; and generally relating to the valuation of an easement to
be purchased by the Agricultural Land Preservation Foundation.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Agriculture

2-510.

(I) (2) The foundation shall adopt by rule and regulation a standard priority
ranking system by which it shall rank each application. The system shall be based on the
following criteria as to the easements offered in any one county:

(i) The applications shall be assigned a rank in ascending order with
respect to the proportion obtained by dividing the asking price by the State [appraised]
easement value. The resulting rank shall be the sole criterion for establishing the
priority for discounted applications that include proportions of 1.0 or lower.
