Ch. 58 LAWS OF MARYLAND

applications for grants, contracts, property, equipment, artifacts, investigations,
administrative and judicial proceedings, rights to sue and be sued, and all other duties
and responsibilities associated with those functions transferred by this Act shall
continue in effect under the Secretary of Housing and Community Development or the
Maryland Historical Trust, .whichever is appropriate, until completed, withdrawn,
canceled, modified, or otherwise changed pursuant to law.

SECTION 9. AND BE IT FURTHER ENACTED, That, if any provision of this
Act or the application thereof to any person or circumstance is held invalid for any
reason in a court of competent jurisdiction, the invalidity does not affect other
provisions or any other application of this Act which can be given effect without the
invalid provision or application, and for this purpose the provisions of this Act are
declared severable.

SECTION 10. AND BE IT FURTHER ENACTED, That the term of the
current members of the Advisory Committee on Archaeology shall expire on July 1,
1990 at which time the Secretary of Housing and Community Development shall
reappoint or add new appointments to the Committee pursuant to this Act. The terms
of the members appointed by the Secretary beginning on July 1, 1990 shall be 3 for a
term of 3 years, 2 for a term of 2 years, and 2 for a term of 1 year.

SECTION 11. AND BE IT FURTHER ENACTED, That any unexpended
appropriation for the purpose of financing any of the archaeological-related activities
herein transferred to the Department of Housing and Community Development shall be
transferred by approved budget amendment to the Department of Housing and
Community Development.

SECTION 12. AND BE IT FURTHER ENACTED, That the Maryland
Historical Trust shall provide for the orderly transition and transfer of personnel and
facilities between the Department of Natural Resources and the Department of
Housing and Community Development. The Department of Housing and Community
Development shall implement, before July 1, 1991, all of the principal recommendations
submitted to the Department of Housing and Community Development by the
Maryland Archaeology Reorganization Committee in 1988.

SECTION 12 13. AND BE IT FURTHER ENACTED, That this Act is an
emergency measure, is necessary for the immediate preservation of the public health
and safety, has been passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two Houses of the General Assembly, and shall take
effect from the date it is enacted. It shall remain in effect until the end of June 30, 1994,
and with no further action required by the General Assembly, this Act shall be
abrogated and of no further force and effect.
