(c) All materials and recorded information which are obtained in violation of
the provisions of [§ 5-620] § 5-620 OR §§ 5-625 THROUGH 5-628 of this subtitle
shall be subject to appropriation by the State, and will be managed, cared for, and
administered by the Trust.

SECTION 4. AND BE IT FURTHER ENACTED, That, in order to provide the
Maryland Historical Trust with the necessary personnel, budget appropriation,
equipment, and materials to carry out its responsibilities under this Act and other
provisions of Article 83B, Title 5, Subtitle 6 of the Annotated Code of Maryland, all
personnel, budget appropriation, equipment, and materials currently assigned to the
Division of Archaeology of the Maryland Geological Survey within the Department of
Natural Resources under §§ 2-301 through 2-310 and 5-1405 of the Natural Resources
Article are transferred to the Maryland Historical Trust within the Department of
Housing and Community Development, except for the personnel, budget appropriation,
equipment, and materials directly associated with the studies performed for and by the
State Highway Administration of the Department of Transportation.

SECTION 5. AND BE IT FURTHER ENACTED, That all personnel, budget
appropriation, equipment, and materials currently assigned to or currently acquired
under contract by the Division of Archaeology of the Maryland Geological Survey
within the Department of Natural Resources that are directly associated with the
studies performed for and by the State Highway Administration are transferred to the
Department of Transportation, State Highway Administration. All persons whose
positions are transferred pursuant to this section are hereby transferred without any
change or loss of rights or status and they shall retain their merit system and retirement
status.

SECTION 6. AND BE IT FURTHER ENACTED, That all persons who, as of
the effective date of this Act, are classified or unclassified employees of the
Department of Natural Resources and whose positions are transferred to the Maryland
Historical Trust within the Department of Housing and Community Development by
this Act are hereby transferred to the Maryland Historical Trust without any change or
loss of rights or status and shall retain their merit system and retirement status. Upon
the promotion, retirement, termination, or resignation of each classified employee
transferred pursuant to this Act, the position shall revert to and shall remain in
unclassified status in accordance with Article 83B, § 5 609 of the Annotated Code of
Maryland.

SECTION 7. AND BE IT FURTHER ENACTED, That, except as expressly
provided to the contrary in this Act, any transaction affected by or flowing from any
statute here amended, repealed, or transferred, and validly entered into before the
effective date of this Act and every right, duty, or interest flowing from it remains valid
after the effective date and may be terminated, completed, consummated, or enforced
pursuant to law.

SECTION 8. AND BE IT FURTHER ENACTED, That, except as otherwise
provided in this Act, all permits and licenses, applications for permits and licenses,
rules and regulations, proposed rules and regulations, standards and guidelines, orders
and other directives, forms, plans, memberships, special funds, appropriations, grants,
