WILLIAM DONALD SCHAEFER, Governor
WHEREAS, The Governor has the power under Article II, Section 24 of the Maryland
Constitution and Section 8-301 of the Maryland State Government Article to
order, not inconsistent with law, the reallocation of functions, powers, and duties
among the departments, offices, agencies, and instrumentalities of the Executive
Branch as he may deem necessary and desirable;
NOW, THEREFORE, I, WILLIAM DONALD SCHAEFER, GOVERNOR OF THE
STATE OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN
ME BY THE CONSTITUTION AND LAWS OF MARYLAND, HEREBY
PROCLAIM THE FOLLOWING ORDER EFFECTIVE IMMEDIATELY:
A. Administration and Implementation.
(1) Administration of the implementation of direct services to clients in
the employment and training and education components of the JOBS Program of
the Department of Human Resources shall be transferred to the Department of
Economic and Employment Development. The Department of Human Resources
shall retain supervision of the Department of Economic and Employment
Development's administration of transferred components of the JOBS Program.
JOBS Program functions, funding as set forth in Section C (4) of this Order, and
staff positions identified in the cooperative management agreement shall be
transferred effective July 1, 1989.
(2) The Department of Human Resources shall implement the Food
Stamp Employment and Training Program through a cooperative management
agreement with the Department of Economic and Employment Development.
Under this agreement, the Department of Economic and Employment
Development shall be responsible for entering into contracts for or otherwise
obtaining services mandated by federal program requirements. Food Stamp
Employment and Training Program functions, funding and staff positions
identified in the cooperative management agreement shall be transferred effective
October 1, 1989.
B. All classified employees subject to the cooperative management agreement
between the departments shall:
(1) Not experience any change or loss of rights or status.
(2) Retain their merit system and retirement system status.
(3) Not suffer any diminution of salary, rate of earned leave, accrued
leave, or seniority rights and status as a result of such transfer.
(4) Not be subject to further examination, qualification, or probationary
period.
C. The Departments of Economic and Employment Development and Human
Resources shall take the necessary steps to transfer the functions and
responsibilities of the JOBS Program and Food Stamp Employment and Training
Program to the Department of Economic and Employment Development as set
