Article 2B - Alcoholic Beverages

117.

[(a) In Carroll, Kent, and Queen Anne's Counties, a person under 21 years of
age may not be employed to sell, deliver, or otherwise deal with alcoholic beverages by
the holder of any Class A (off-sale), Class B (on-sale), or Class C (on-sale) beer, wine
and liquor license except a person 18 years of age or older may stock alcoholic
beverages in establishments operating under such Class A (off-sale) license and may
serve alcoholic beverages while acting in the capacity of a waiter or waitress in
establishments operating under such Class B (on-sale) or Class C (on-sale) licenses,
and a person under the age of 18 may not be employed to sell, deliver, or otherwise deal
with alcoholic beverages by the holder of any alcoholic beverage license in these
counties. This subsection does not prohibit the employment of anyone under the age of
21 years by a holder of an alcoholic beverage license in Carroll, Kent, and Queen
Anne's Counties for any purpose other than selling, delivering, or otherwise dealing
with alcoholic beverages.]

(A) (1) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, AND
EXCEPT AS PROVIDED BY PARAGRAPH (2) OF THIS SUBSECTION, A
PERSON UNDER THE AGE OF 21 MAY NOT BE EMPLOYED TO SELL,
DELIVER, OR OTHERWISE DEAL WITH ALCOHOLIC BEVERAGES BY ANY
OF THE HOLDERS OF THE LICENSES LISTED BY COUNTY IN PARAGRAPH
(3) OF THIS SUBSECTION.

(2) (I) A PERSON AT LEAST 18 YEARS OF AGE MAY BE
EMPLOYED:

1. TO STOCK ALCOHOLIC BEVERAGES IN A CLASS A
ESTABLISHMENT; OR

2. EXCEPT FOR CLASS A LICENSES, TO SERVE

ALCOHOLIC BEVERAGES WHILE ACTING IN THE CAPACITY OF A WAITER
OR WAITRESS ON THE LICENSED PREMISES.

(3) THE PROVISIONS OF THIS SUBSECTION APPLY:

(I) WITHIN KENT AND QUEEN ANNE'S COUNTIES, TO THE
HOLDER OF ANY:

1. CLASS A (OFF-SALE) LICENSE;

2. CLASS B (ON-SALE) LICENSE; AND

3. CLASS C (ON-SALE) BEER, WINE, LIQUOR
LICENSE; AND

(II) WITHIN CARROLL COUNTY, TO THE HOLDER OF ANY:
1. CLASS A LICENSE;
